Dr Phil's Supplements: Class Action Lawsuit?

When Dr Phil McGraw came out with his own line of supplements - his credibility took a real hit. It's one thing to write insightful self-help books - but promoting diet supplements is another thing altogether.

Dr Phil created the Shape Up! brand - which even included having his diet online via eDiets (the relationship was soon disbanded). The line of Shape Up! supplements came to the attention of the FTC after claims of false advertising.

The supplements (made by CSA Nutraceuticals) were removed from the market after just a year - but the lawsuits continue.
Three disgruntled customers, who filed the suit last year in Los Angeles County Superior Court, now are seeking national class-action status for the complaint, which could expand it to include thousands of plaintiffs. A judge could rule on the question early next year.
Class-action status? That's quite a step up from the current lawsuits.

It's amazing how many diet authors also have a supplement business on the side. Off-hand I can think of a few; Dr Mercola, Jordan Rubin (The Maker's Diet), Dr Rosedale (Rosedale Diet), Dr Nicholas Perricone. I'm sure there are many more.

AS YOU SAY THERE ARE MANY WHO HAVE DIET SUPPLEMENTS ON THE MARKET. WHY IS IT THAT OUR GOVERNMENT ALLOWS THIS AT ALL. PEOPLE ARE DESPARATE TO LOSE WEIGHT AND TRY ANYTHING AND EVERYTHING. I AM SURPRISED DR.PHIL WOULD DO THIS. HOW GREEDY CAN A PERSON BE. ISN'T HE MAKIING ENOUGH MONEY WITH HIS SHOW AND BOOKS. I LIKE DR PHIL'S ADVICE MOST OF THE TIME BUT I THINK HIS HEAD IS STARTING TO SWELL. MAYBE HE NEEDS SOME ADVICE FROM AN OBJECTIVE PERSON OR DOCTOR. HE NEEDS TO GET OVER HIMSELF A BIT.HE ACTS LIKE HE HAS ALL THE ANSWERS AND THE PERFECT FAMILY. I LOVE HOW HE WELCOMED HIS SON JAY'S GIRL ERICA. NO MENTION OF HER PLAYBOY PAST AT ALL. ON ONE SHOW DR.PHIL SAYS "FOR SOME REASON OUR SON JAY ONLY DATES MODELS". THEN THEY HAVE JAY ON THE SHOW GOING UNDERCOVER LOOKING LIKE A GEEK AND ACTING LIKE HE CAN'T BELIEVE HOW HE WAS TREATED. HOW COME JAY NEVER GIVES A PLAIN GIRL A LOOK OR A DATE. DR. PHIL NEEDS A WAKE UP CALL AND THIS SUIT COULD BE IT.

That is what we need - more weight loss products that don't work.

Why would anyone take weight loss advice from Dr. Phil who seems unable to loose that last 20 - 30 pounds?

What are Dr. Phil's BMI and percent body fat?

I say if people are stupid enough to take advice from someone who is fat himself, they deserve to be taken. Not that I think someone who purports himself to be an expert on everything, like Dr. Phil does, should have gone ahead and taken advantage of the idiots. The lawsuit should be thrown out for plain idiocy

Yeah, no kidding...it's not like Dr. Phil is the svelte, athletic type ;) Supposedly, he plays tennis a lot, but I don't think I'd buy anything from him either. Even if he is a self-proclaimed "expert" on losing weight.

Dr. Phil is a psychologist and has no business dispensing medication. There are even questions as to whether he is or is not a psychologist, and since it is now public information that this guy is a phony (i.e.is not what he says he is or claims that he is) someone ought to be checking his credentials so that more charges can be brought against him. It is likely that his "psychological advice" has harmed some people who didn't know any better and took his advice and it backfired on them. Anyone who is in this "class" should also be filing a lawsuit which alleges damage, if in deed there were any damages!

When Dr. Phil's latest book was first released, he went on Larry King Live and said the diet industry was full of scams.

I agree with all the comments. What would any psychology know about losing weight, unless the book was about psychological steps to overcome eating? They are not trained in human physiology at all.

Also, yeah, the man is overweight and overfat. He looks like your typical former athlete that didn't change his eating and became fat. Because of his athletic background, I'd say that he must eat very badly, cause he must have had good genes for starters. It must take him a lot of overeating and eating high-calorie foods to stay that fat.

The only good advice to ever come out of Dr. Phil is the day he had his wife on the show and she mentioned she took natural thyroid hormones, and told other people with thyroid problems to find a doctor who'd consider using them. It was the first and only time anyone advocated their use on national tv. It would have been better if she were a doctor, but it is something already.

From what I've read thus far on this blog, it appears that we enjoy building people up, just to grab the opportunity to tear them down again. I find Dr. Phil's programs to be consistently GOOD. Further, using The Ultimate Weight Solution, I lost 20 pounds. People have differing opinions - of course - but all I see here is a lot of griping and nastiness. For shame.

I believe in the adage "By their fruit you shall know them". If Dr Phil has been helpful for you -- and I know MANY people who have found him to be immensely helpful - - then by all means read and use the books.

I will say that Dr Phil has the ability to completely polarise opinion of himself. People seem to love him or hate him.

This reminds me of the time I went to the dermatologist for a prescription for my skin....the Doc told me I did not need the prescription but rather the skin care products that his daughter was selling upstairs (very pricey too!)He told me it was better than anything I might purchase in the department store and that if my skin did not get better it was my fault for not purchasing that brand....so I paid for a consult to get told to buy his daughters expensive cosmetics!

The general public is naive. Dr. Phil does tell it like it is and I know that because we have been friends for almost 20 years. Weight loss or not, the diet pills and supplements we agreed were not in his best interest. I think he was asked by his former partner to do this and he did as a departing nice jesture. No good deed goes unpunished and this pretty much proves that....

like he really needed another source of income......he jumped into this business (which i know alot about) without thinking it out......in doing so, he will have to answer to all the people he advertised to using his
status and program as his catalyst. Has anyone ever heard the story by his ex-partner which he left in the dust?....what comes around goes around. He simply isnt a very "on the level" nice guy.

I don't get it. Weightloss is obviously mostly psychological. We all know what we should do to loose weight (eat less, and properly and get some exercise), but we find it so hard to do this. Pills don't do nothing. Fancy diets don't do nothing. You need some way to motivate yourself to eat sensibly (fewer calories, more nutritious) and move more (some regular exercise). This is all psychological. A good psych can help you loose weight more so than a doctor (who will just tell you what you know already).

But if Phil has the answer, why is he such a lard arse?

Dr. Phil - Your program today was very interesting and also amusing. I had a mother-in-law similar to the one on your program. She was finally told by her best friend that she had already caused two divorces in her family and to leave the third marriage alone. I also saw my mother-in-law crying one day as she read a letter from her daughter - divorced - saying she had been a failure too. Her daughter has been married three times, lived with several men, and is single now. "The apple doesn't fall far from the tree."

I have been in the Health and Fitness arena for over 30 years. I have had many products on the market and HAVE NEVER BEEN SUED. Phil is a quick buck artist , who after the queen Opra said he was a good guy, took his name recognition and without any expertise suddenly became an expert on fitness and weightloss. The garbge information and products he pumped out deserve a big lawsuit. The man is simply a bald fat ass who needs to practice what he has preached. Listen up all you sheep the Marthas. Opras, and Dr Phils of the world don't know any more than you, they just know how to con people into thinking that some great bolt of wisdom has made them have all the answers, WAKE UP AND STOP MAKING THEM RICH!

I agree with the posts, but I have to say that I saw him last weekend at the MGM Hotel in Las Vegas. He was with Robin and his son Jay and Jay's new wife. I was in the lobby and they walked right by me. He was in a suit with his jacket off, and I was surprised because he looks much slimmer in real life than he does on tv - particularly in the face and stomach area. Jay didn't look as chunky (or short) as I thought he would be. Robin looked very happy but the skin on her face was stretched really tight (too much botox???), and Erica had so much make-up and fake a tan caked on that she looked like a Vegas showgirl. I used to like Dr. Phil, but now he's pandering to tv ratings and his shows are entering the "Hollywood Zone".

He (Dr. P.) has turned into a combination of Jerry Springer, Maurie Povitch, & Geraldo Rivera...a real monster. He should get some professional help before completely self-destructing.

I watch Dr. Phil almost every day and cannot believe these seemingly intelligent people will get on a program like his and tell some of the most intimate, personal things about themselves. At first he was giving advice to help people, but now he offers professional help. Where on earth did he dig up Frank Lawless? Doesn't he do research? I heard this man on Coast to Coast talk about aliens from outer space.

Some people are so desperate and lonely that they turn to anyone on TV talk shows and decide that their word is from GOD. Doctor Phil tells people that they have to earn their way out of a marriage--but he doesn't talk about how his first wife divorced him because he couldn't keep his pants zipped. He even has his wife giving advice--and what schooling does Robin have? People turn to Robin for advice about beauty products that keep your skin so youthful--what makes her qualified in health care products? Until Doctor Phil owns up to the mistakes he personally has made in the past, why should someone respect him for the long marriage that he now has? His son is an attorney but makes more money by being on his Dad's show! $45 million a year is Mighty big bucks when you don't even have a license to practice! And everyone in this family can crank out the books! We all need to look carefully before deciding who is the most qualified to help us make life decisions--who says the advise that Doctor Phil gives is any more sound than the advice given by Kermit the Frog????
