Xenadrine Makers Pay $1 Million
"People struggling with weight issues are entitled to realistic expectations of what a product will do for them, not some false hope that has been put before them and can't be achieved," said the consumer affairs director of New Jersey.
To that end, Nutraquest and two other affiliated companies will be settling a $1 million dollar lawsuit. The lawsuit relates to the effectiveness of the Xenadrine RFA-1 product. This product is no longer available and has been replaced by it's ephedra-free counterpart Xenadrine EFX. These are the restrictions that Nutraquest must abide by:
They won't say the products by themselves cause weight loss without diet or exercise.They won't claim the products cause weight loss via a specific biochemical mechanism unless they have scientific evidence to support the claim.
They will require people who endorse products to submit a sworn statement about their use of the products and the results they achieved.
They won't use endorsements that demonstrate weight loss results that aren't typical of what an average consumer can achieve unless they disclose the results aren't typical.
They won't advertise that a product is more effective than another product unless they can substantiate the claim.
They won't advertise a weight loss product through print, the Internet or over the telephone without advising the consumer to consult a health care professional before beginning a weight loss program and to read the product label before taking it.
In a timely reminder, a small study has also shown that products containing ephedra and guarana are hard on the heart.
...dietary supplements containing ephedra and guarana or like-compounds could have unfavorable cardiovascular effects, especially in susceptible individuals such as those with high blood pressure, glucose intolerance or hardening of the arteries.
Although Ephedra is banned, there are of course still many ways one can get hold of ephedra-based products.
